Terrible but it is legal. I love how people exercising their constitutional right to a fair trial is considered "problematic". Further proof, that even in Idaho, the government continues to encroach on our freedoms under the guise of "safety".
I would still argue that the right to counsel attaches as soon as the police have reason suspicion and while the police may be able to draw blood they can't do anything once you have invoked that right.
Try getting an attorney to show up on an isolated road at 2:00 am.

Oh my - that is horrible. I guess I would have to refuse it and take the punishment for that instead.
